Dutch Officials Pitch Overhaul of Bank Legal Settlements

Proposed legislation in the Netherlands would give courts authority to scuttle monetary settlements of violations by banks and other businesses seeking to avoid criminal prosecution. On Mar. 11, the Dutch Ministry of Justice and Security requested feedback from the private sector and other parties on a 13-page bill that would require prosecutors to obtain judicial approval before resolving serious violations with a fine and obligatory remedial measures, rather than with criminal proceedings.
